These Terms of Service ("Terms") govern your use of qik.site and any services provided by qikSite ("we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.
1. Services
qikSite provides website design and development, hosting and maintenance, local SEO, Google Business Profile management, lead capture and automation, custom business tools, and related consulting services (the "Services"). The specific scope, deliverables, and pricing for your engagement are set out in your proposal or service agreement.
2. Accounts and responsibilities
Where we manage accounts on your behalf (hosting, domain, Google Business Profile, analytics, third-party platforms), you remain the owner of those accounts and their data. You are responsible for providing accurate business information, timely content approvals, and lawful authority to act on materials you supply to us.
3. Payment and cancellation
Subscription services are billed monthly in advance. Setup fees, where applicable, are due before work begins. Unless stated otherwise in your service agreement, engagements carry an initial minimum term (typically three months) and continue month-to-month afterward. You may cancel month-to-month services with written notice; cancellation takes effect at the end of the current billing period.
4. Ownership
You own your domain, your content, and your business data. On request, and upon payment of all amounts due, we will provide a copy of your website and exportable data. We retain ownership of our internal tools, frameworks, and reusable components used to deliver the Services, and may reuse general learnings and non-client-specific components across engagements.
5. Third-party services
The Services may rely on third-party platforms (for example hosting providers, Google, email and SMS delivery services, payment processors, and field-service software). Those third parties' terms apply to your use of their platforms, and we are not responsible for their availability, actions, or policy changes.
6. No guarantees
Search rankings, traffic levels, lead volumes, and revenue outcomes depend on factors outside our control, including search engine algorithms, competitor activity, and market conditions. We do not guarantee specific rankings, traffic, or business results. Any figures we present as estimates or projections are just that — estimates, not commitments.
7. Limitation of liability
To the maximum extent permitted by law, qikSite's total liability arising from or related to the Services is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
8. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page, and material changes will be flagged with a new "last updated" date. Continued use of the Services after a change constitutes acceptance.
